Team Rider Terms
XDreamKidz Team Riders Terms & Conditions
By joining the XDreamKidz Team Rider Program (“Program”), you (“Rider”) agree to the terms below. XDreamKidz LLC (“XDreamKidz,” “we,” “our,” “us”) may update these terms from time to time; continued participation constitutes acceptance of any updates.
1) Independent Rider Status
- Riders are independent athletes/ambassadors, not employees, partners, or agents of XDreamKidz.
- Riders are solely responsible for their actions, safety, and conduct.
- No authority is granted to bind XDreamKidz to any agreement.
- Rider is responsible for all taxes and filings related to any benefits, stipends, or affiliate payouts (W-9 may be required for U.S. Riders if cash/merch value meets reporting thresholds).
2) Assumption of Risk & Liability Waiver
Motocross and similar activities involve inherent risks (including serious injury or death). To the fullest extent permitted by law, the Rider (and, if under 18, the Rider’s parent/legal guardian) voluntarily assumes all risks and agrees to release, defend, indemnify, and hold harmless XDreamKidz LLC and its owners, affiliates, employees, sponsors, and partners from any and all claims, losses, liabilities, damages, or expenses arising from participation in riding, training, events, travel, or content creation associated with the Program.
3) Required Social Media Activity
- Profile Sponsorship: Rider must include on each active social profile bio: “Sponsored by @XDreamKidz” (or a clear equivalent linking to the official account).
- Website & Discount Code in Bio: Rider must display {{ shop.url | default: 'https://www.xdreamkidz.com' }} together with their personal XDreamKidz discount code in their social profile/bio.
- Posting Frequency: Minimum of 2 posts per week on primary platforms (Instagram, TikTok, Facebook, YouTube). Posts should reasonably represent the XDreamKidz brand, values, gear, or rider activity.
- Live Mentions: When going live, Rider must say “XDreamKidz” at least once per live.
- Tagging & Hashtags: Tag @XDreamKidz in captions and media where relevant. Use #XDreamKidz and #XDKTeam when appropriate.
- Team Rider Package Unboxing: Upon receiving the “Team Rider Package,” Rider must post an unboxing and review within 7 days and tag @XDreamKidz.
- Monthly Share: Rider must share/repost at least one official XDreamKidz post per month and tag @XDreamKidz.
- Monthly Engagement: Rider must like and comment on at least 3 XDreamKidz posts per month.
- Deliverables Tracking: We may periodically request a simple monthly summary of links/screenshots to verify deliverables have been met.
4) FTC & Platform Compliance
- Rider must comply with applicable endorsement/advertising disclosure rules (e.g., U.S. FTC Endorsement Guides) and the policies of each platform.
- Disclosures must be clear and conspicuous (e.g., #ad, #sponsored, or “Paid partnership with XDreamKidz”) and placed so viewers cannot miss them (e.g., near the start of captions; spoken/onscreen at the beginning of videos/lives).
- Affiliate links, discount codes, or free product must be disclosed as such.
5) Content Standards
- Professionalism, sportsmanship, and legal compliance are required at all times.
- No hate speech, harassment, illegal activity, or dangerous/deceptive practices. Do not depict or encourage unsafe riding or stunts without proper safety gear and context.
- XDreamKidz may request edits or removal of content that misuses our trademarks or misrepresents the brand.
6) Apparel, Logos & Event Representation
- When practical, Rider agrees to wear/feature XDreamKidz apparel or decals during events, practices, and content sessions.
- Brand asset use must follow any guidelines we provide (logo placement, colors, proportions). We may update guidelines from time to time.
7) Exclusivity & Conflicts
During participation, Rider agrees not to represent or promote competing youth action-sports apparel/merch brands without prior written consent from XDreamKidz. Equipment/parts sponsors are allowed unless directly conflicting with an active XDreamKidz collaboration.
8) Safety & Rules of Competition
- Rider must follow all event, facility, and sanctioning-body rules (e.g., AMA/local equivalents) and use appropriate protective gear.
- Rider is solely responsible for equipment condition, maintenance, and safe operation.
9) Content Rights & Name/Likeness License
Rider grants XDreamKidz a non-exclusive, worldwide, royalty-free, perpetual license to use, repost, adapt for format, and feature Rider-created content that includes XDreamKidz products, marks, or affiliation for marketing and promotional purposes across any media, with reasonable credit where feasible. Rider also grants a license to use Rider’s name, image, voice, and likeness in connection with such content. Rider retains ownership of original content.
10) Minors, Model Release & Parent/Guardian Consent
If Rider is under 18, a parent or legal guardian must review and consent to these terms and to the use of Rider’s name, image, and likeness as above. Parent/guardian is responsible for ensuring compliance with these terms and applicable child-privacy rules.
11) Program Benefits & No Guarantee
Program perks (discounts, product support, event features, affiliate codes, etc.) are discretionary and may vary. Participation does not guarantee compensation, specific product allocations, renewals, or future opportunities.
12) Rider Support Tiers & Advancement
XDreamKidz may operate a rider support system (e.g., Silver, Gold, etc.). Advancement is performance-based and at XDreamKidz’s sole discretion, taking into account engagement quality, consistency, community impact, and verified discount-code usage attributable to the Rider. Meeting the minimum requirements outlined in Section 3 does not guarantee advancement or any particular benefit level.
13) Confidentiality & Non-Disparagement
- Non-public information about XDreamKidz (pricing, unreleased products, internal communications) must be kept confidential.
- Rider agrees not to make false statements that materially harm the brand, our partners, or community.
14) Term, Monitoring & Remedies
- XDreamKidz may monitor public profiles to verify deliverables and disclosures.
- We may suspend or terminate participation at any time, with or without cause (e.g., failure to meet posting/tagging or disclosure requirements, inactivity, or conduct issues).
- We may withhold or rescind perks (e.g., discounts/shipments/affiliate payouts) if requirements are not met.

15) Intellectual Property & Brand Assets
All XDreamKidz names, logos, and marks are the property of XDreamKidz LLC. Permission to use brand assets may be revoked at any time. No ownership or license is granted beyond what’s expressly stated here.
16) Notices
We may provide notices via email to the address on file or via direct message to your primary social account. Rider agrees that email or platform DM is an acceptable method of notice.
17) Governing Law, Dispute Resolution & Venue
These terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration in Oregon before a single arbitrator under applicable rules, except that either party may seek injunctive or equitable relief in Oregon state or federal courts to protect intellectual-property or confidential-information rights. Venue and jurisdiction lie exclusively in Oregon.
18) Electronic Acceptance
By clicking “I agree,” submitting an application, or continuing to participate in the Program, Rider (and parent/guardian if under 18) accepts these terms electronically with the same force as a signed agreement.
